EDUCATION CITY DIGITAL PLATFORMS TERMS AND CONDITIONS

QATAR FOUNDATION FOR EDUCATION, SCIENCE, AND COMMUNITY DEVELOPMENT (hereinafter referred to as “Qatar Foundation” or “QF”), a private institution for public benefit established pursuant to Law No. 21 of 2006 with registered address P.O. Box 5825 Doha, Qatar.

These terms and conditions govern your use of our Education City Digital Platforms, including the Education City Website (educationcity.qa) and the Education City mobile app (iOS or Android). Please read these terms in full before you use the website/application. If you do not accept these terms and conditions, please do not use the platforms. Your continued use of the platforms show acceptance of all the mentioned hereby.

  1. USE OF EC DIGITAL PLATFORMS
    1. We take all reasonable measures to ensure that the EC platforms are operational all day, every day. However, occasionally, technical issues may result in some downtime, and accordingly, we will not be liable if the EC platforms are unavailable at any time. We may provide advanced notice of maintenance issues resulting in EC Platforms downtime, but we shall not be obliged to provide such notice.
    2. Any material that a visitor sends to the EC platforms shall be considered non- proprietary and non-confidential. We shall be entitled to copy, disclose, distribute, or use for such other purpose as we deem appropriate all material provided to us, except for personal information, the use of which shall be in accordance with our privacy policy, which shall be deemed part of these terms and conditions.
    3. When using the EC Platforms, you shall not:
      1. Send to or from platforms any material for which you have not obtained all necessary consents;
      2. Send to or from the EC platforms any material that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the State of Qatar;
      3. Send to or from the platforms any harmful material including, and without limitation, computer/ mobile viruses, corrupted data, or other potentially harmful software or data.
      4. Publishing any platforms’ material in any other media.
      5. Selling, sublicensing and/or otherwise commercializing any platforms’ material
      6. Publicly performing and/or showing any platforms’ material.
      7. Using the platforms in any way that impacts user access to the platforms
      8. Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to the platforms.
      9. Using the platforms to engage in any advertising or marketing.
    4. User Responsibility: It is the user's responsibility to thoroughly review and agree to the terms and conditions, including the refund policy, of each activity before registering or enrolling in any paid activity.
  2. THIRD-PARTY SITES
    1. EC Platforms may include hyperlinks to other websites. Your use of each of these third-party websites is subject to the terms and conditions posted on the applicable website. Qatar Foundation has no control over such third-party websites, and the inclusion on the EC Platforms of a hyperlink to any third-party website is not an endorsement by Qatar Foundation of such website, or to any content, products or services available on it. Any use of such hyperlinks or third-party sites is at your sole risk.
    2. Any party wishing to link to EC Platforms is entitled to do so provided that the conditions below are observed:
      1. you do not seek to imply that Qatar Foundation is endorsing the services or products of another party unless this has been agreed with us in writing;
      2. you do not misrepresent your relationship with the EC Platforms; and
      3. the website from which you link to the EC Platforms does not contain offensive or otherwise controversial content or content that infringes any intellectual property rights or other rights of a third party.
  3. INTELLECTUAL PROPERTY RIGHTS
    1. “Qatar Foundation” and “Education City” are the trademarks, trade names, and service marks belonging to Qatar Foundation. Any use of such mark without the prior written consent of Qatar Foundation is prohibited. Other trademarks and logos are the property of the parties to whom they are attributed.
    2. The content and compilation of content included on EC platforms, such as text, graphics, logos, icons, images, audio clips, digital downloads and software, are the property of Qatar Foundation and are protected by copyright laws. Such copyright protected content cannot be reproduced without Qatar Foundation’s express written consent.
  4. INDEMNITY

    You hereby agree to indemnify, release, and hold Qatar Foundation, its affiliates, agencies, licensees and their employees and directors harmless from any and all injuries, liability, losses, and damages of any kind resulting from your use of the EC Platforms including without limitation (i) any breach or alleged breach by you of these terms and conditions, (ii) any claim that any content submitted by you caused damage or loss to a third party and/or (iii) any breach of any intellectual property right of any third party.

  5. NO WARRANTY
    1. We take all reasonable steps to ensure that the information on the EC platforms is up to date and accurate at all times. However, we do not guarantee that all material is accurate and/or up to date.
    2. All materials contained on the EC platforms are provided without any warranty of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for purpose or warranty of non- infringement. You may use the material on the EC platforms at your own discretion.
    3. Limitation of Role as Intermediary: The EC platforms serve solely as a liaison between users and activity organizers. The EC platforms are not liable for any issues that may occur before, during, or after an activity. These issues might include cancellations, rescheduling, or dissatisfaction with the activity, or other related matters. As an intermediary, the Education City platforms does not endorse or assume responsibility for the conduct of any activity organizer. In cases of concerns or issues arising from an activity, the Education City platforms will provide contact information of the activity organizers to resolve any issues.
  6. LIMITATION OF LIABILITY

    To the maximum extent permitted by law, in no event shall Qatar Foundation, its affiliates, its licensors or employees be liable, whether in contract, warranty, tort (including negligence), or any other form of liability, for:(i) any indirect, special, incidental or consequential damages that may be incurred by you; (ii) any loss of data, income, business or profits (whether direct or indirect) that may be incurred by you; and (iii) any claim, damage, or loss which may be incurred by you in connection with your use of or inability to use the EC Platforms (including, but not limited to, your reliance upon any content appearing on the EC Platforms or any linked sites).

  7. CHANGES & MODIFICATIONS

    Qatar Foundation reserves the right to change these terms and conditions at any time. Such changes will become effective and binding after they are posted on the EC Platforms. You hereby agree to regularly review these EC Platforms terms of use and be aware of the changes made. By continuing to use the EC Platforms after any posted revision, you agree to abide by it.

  8. LAW & JURISDICTION

    These terms and conditions are governed by laws of the State of Qatar. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the State of Qatar.

    Any disputes between users and organizers regarding activities, including refund requests, must be resolved directly between the parties involved. The EC Digital Platforms are not responsible for mediating or resolving such disputes.

  10. SEVERABILITY

    If any provision of these terms of use is held unenforceable, that provision shall be severed, and the remainder of these terms of use will continue.

  11. Refund Policy
    1. Variability by Organizer: The refund policy for activities accessible through the EC platforms varies depending on the organizing entity. Each organizer sets its own terms and conditions, including refund policies, which are presented as part of the registration process for an activity. It is the user's responsibility to review and agree to these policies before registering for paid activity.
    2. Platform's Role: The EC platforms do not set a general refund policy applicable to all activities and are not liable for refunds or misrepresentations regarding individual organizer policies. Users must direct any refund requests or disputes directly to the activity organizer, whose contact details are provided during the registration process.
    3. Refund Processing: Refunds approved under the above conditions will be processed. Please note that the exact timeframe for receiving the refund may vary depending on the organizer’s refund policy and your bank or payment service provider.
